1. DEFINITIONS
The following terms shall have the following meanings respectively in these Conditions:
1.1. “Card” a credit or debit card of the type described in clause 9.2. below
1.2. “Conditions” these terms and conditions
1.3. “Consumer Protection Regulations” means The Consumer Protection (Distance Selling) Regulations 2000.
1.4. “Customer” the person attempting to or actually performing a purchase via the Web Site;
1.5. “Event” the Silverstone Classic motor racing event
1.6. “Force Majeure” any cause adversely affecting the commencement or continuation of the Event on any particular date arising from acts events omissions happenings or non happenings beyond the reasonable control of the Suppliers including (but not limited to) inclement weather governmental regulations days of national mourning animal or human disease fire flood or any disaster or industrial dispute affecting any of the Suppliers or a third party.
1.7. “SSL” Secure Socket Layer which is a protocol used on the Internet to encrypt data to ensure secure transmission and usually is denoted by a padlock symbol at the bottom of the Customer’s browser.
1.8. “Site” the Silverstone Circuit, Silverstone, Near Towcester, Northamptonshire including any building on the Site.
1.9. “Suppliers” Classic Historic Racing Limited of Sweetapple House, Catteshall Road, Godalming, Surrey. GU7 3DJ
1.10. “Web Site” This web site or any other web site from which the Suppliers conduct their business of organising the Event.
1.11. “Working days” Monday to Friday, excluding Bank or other Public holidays;
1.12. “Working Hours” 0830-1700 UK Time on the Working Days;
2. BACKGROUND
2.1. “Rocking and Racing” and the stylised guitar/race track logo are the Trade Marks of the Suppliers
2.2. "Silverstone Classic" is the Trade Mark of The British Racing Drivers’ Club Limited whose registered office is: Eighth Floor, 6 New Street Square, London, EC4A 3AQ.
2.3. The Speedmark Logo is the Trade Mark of The British Racing Drivers’ Club Limited whose registered office is: Eighth Floor, 6 New Street Square, London, EC4A 3AQ.
2.4. The Event is held at the Site
2.5. The Event is organised by the Suppliers.
2.6. There may be delivery options available to the Customer when placing an order.
3. APPLICATION OF CONDITIONS
The Conditions apply in their entirety to:
3.1. all the Suppliers’ operations including those of any or all of their respective agents partners affiliates joint ventures organisers managers and companies under the management or control of the Suppliers or their holding company (however involved) in the supply of products and or services on behalf of the Suppliers and
3.2. the use of the Web Site for any purpose
3.3. all contracts of any kind with the Customer
4. PRIORITY OF SALES AND PURCHASE TERMS
4.1. The Conditions have priority over all conditions of sale and purchase issued by any third party or the Customer
4.2. Any purchase terms and conditions issued or claimed by the Customer are hereby excluded in their entirety (other than any implied conditions contained in any applicable Consumer Protection Regulations so far as they are required by statute to apply to any transaction between the Customer and the Suppliers)
4.3. Where any implied terms apply to any such transaction and where there is conflict between the Conditions and any such implied conditions the Conditions so far as is permitted by law or statute shall prevail.
4.4. The order of precedence (in the priority of the legal provisions applying to any transaction relating to the Event) is:
4.4.1. any specific or additional terms and conditions or limitation of use applied to individual products tickets services or promotions issued or provided by the Suppliers or any other person or entity on their behalf;
4.4.2. these Conditions in their entirety.
5. SERVICE TERMS
5.1. The Suppliers reserve the right to refuse to trade with any person or entity whatsoever at their sole discretion without any liability of any kind to the Customer.
5.2. Without prejudice to the above reservation the Suppliers reserve the right particularly to refuse to trade with any individuals whose credentials cannot be verified (including those living in countries where credit/debit card fraud is known to be active).
5.3. The Suppliers will use their own sole discretion in these matters and the resultant decision will be final.
5.4. The Suppliers shall not be obliged to provide the Customer with any reason for declining to supply any Customer.
5.5. Any decision by the Suppliers not to accept an order does not imply that the Suppliers consider that the Customer who made that order is engaged in any fraudulent or other delinquent conduct.
5.6. Methods of ordering and purchasing include:
5.6.1. via the Internet via this Web Site;
5.6.2. by telephone using the numbers advertised and following the procedure described by the representative who deals with the Customer over the telephone;
5.6.3. by post and cheque (at least ten (10) Working Days must be allowed for clearance);
5.6.4. by Card on the day of the Event.
5.7. All tickets, products and services are subject to availability.
5.8. The Suppliers make reasonable efforts to supply goods and services as advertised but reserve the right to vary or withdraw:
5.8.1. the performers at any concert;
5.8.2. the content of any grids and drivers in any race program;
5.8.3. the holding of any race or any other attraction;
5.8.4. the content and design of any goods and
5.8.5. the scope of any services at any time at their sole discretion.
5.9. If the Suppliers cannot supply the goods or services ordered by the Customer the Suppliers reserve the right to offer goods or services of equal or superior quality or value at no extra cost.
5.10. In such case if the Customer does not wish to accept the alternative goods or services offered by the Suppliers the Customer may cancel the order and require any money paid to the Suppliers in respect of that order to be refunded.
5.11. Subject to statute law, the risk of a Force Majeure event shall be carried by the Customer alone but the Suppliers may (at their absolute discretion and subject to availability of the Site) offer an alternative date for the day affected by a Force Majeure event
5.12. If in their discretion the Suppliers decide that a happening is not sufficiently serious to constitute a Force Majeure event the Event will continue although the programme and attractions of the Event may be disrupted.
5.13. Where (in spite of its reasonable efforts) the Suppliers are unable to perform an obligation due to Force Majeure it shall not be in breach of its contract with the Customer.
6. ORDER FULFILMENT
6.1. Goods and services are invoiced at the price with VAT at the rate prevailing at the time of completion of the purchase.
6.2. The Suppliers reserve the right to modify the prices from time to time prior to any order being made by the Customer.
6.3. Paid orders will be acknowledged with a payment confirmation e-mail if an email address is supplied by the Customer.
6.4. Subject to contact details being provided by the Customer at the time of order if:
6.4.1. any tickets ordered by the Customer are sold out the Suppliers may contact the Customer to:
6.4.1.1. advise of any alternative tickets which are still available and
6.4.1.2. enquire if the Customer wishes to receive any alternative tickets or not to proceed with any purchase of tickets for the Event.
6.4.2. any products ordered by the Customer are out of stock the Suppliers may contact the Customer to:
6.4.2.1. inform the Customer of an estimated delivery date and
6.4.2.2. enquire if the Customer wishes to receive an alternative product or not to proceed with any purchase from the Suppliers at that time.
9. PAYMENT PROCESSING (Card transactions)
9.1. Payment processing is performed via SSL between the servers performing on behalf of the Suppliers and the banking institutions.
9.2. The Suppliers accept the following Cards only:
9.2.1. MasterCard;
9.2.2. Visa;
9.2.3. Switch and
9.2.4. Solo
9.3. Without prejudice to any general reservation contained elsewhere in these Conditions the Suppliers reserve the right to refuse to:
9.3.1. trade with any person where fraudulent use of credit/debit cards is suspected as determined by the Suppliers at their sole discretion;
9.3.2. transact with any country where the potential fraudulent use of Cards is considered by the Suppliers (or their bankers) as an excessive risk.
9.4. The Customer must be the card holder named on the Card to be used to make payment for the order.
9.5. All Card details must be entered correctly on the order form as incorrect data will result in the Card being rejected for payment and can cause delays to the order fulfilment process and disappointment for the Customer.
9.6. Payment is charged to the Card on confirmation of successful payment by the Card issuer and the items ordered by the Customer are in stock.
9.7. Where the Customer nominates a recipient and/or delivery address which is different from the Customer’s address shown in the Card details the invoice or billing address must the same address as that of the Customer in those Card details.
9.8. The Suppliers reserve the right to request additional identification of any kind at their discretion to assist with Card or address verification.
9.9. The Suppliers reserve the right to use a third party secure payment body to process payments.
10. POSTAGE & DELIVERY
10.1. Prices and delivery information are described on the Web Site.
10.2. Postage of tickets incurs a charge of £1.95 postage and packaging for first class post and £6.50 postage and packaging for secure post.
10.3. Any time or date stated for delivery is an estimate only.
10.4. The Suppliers make every effort to dispatch tickets or goods on time but shall not be liable in any way to the Customer if delivery does not occur within the stated time.
10.5. Delivery is provided through third party courier (at the request and extra cost of the Customer) and postal companies and the Suppliers are not liable for delays or loss incurred.
10.6. Some orders will require a signature on delivery.
10.7. In such case a delivery address where the order can be signed for in normal Working Hours must be provided.
10.8. The Suppliers do not accept liability for shortages or damage to deliveries unless the Customer notifies the Suppliers of the shortage or damage in writing within five (5) Working Days of receipt of the delivery.
10.9. The Customer must accept the tickets or goods when they are ready for delivery.
10.10. Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address.
10.11. The risks of loss breakage and all damage shall pass to the Customer on delivery.
10.12. Title in the goods does not pass to the Customer until payment is received in full by the Suppliers.
10.13. If the Customer cannot accept delivery the Suppliers may at their sole option:
10.13.1. store and insure the tickets or goods at the Customer’s expense and risk or
10.13.2. sell the tickets or goods at the best price reasonably obtainable and (after deducting reasonable storage insurance and selling costs) pay to the Customer any excess over the sale price or charge the Customer for any shortfall.
11. OUT OF STOCK AND NON-AVAILABILITY
11.1. Products out of stock but on order are normally delivered within twenty (20) Working Days but can occasionally take longer.
11.2. Items that are no longer available will be:
11.2.1. removed from the Web Site;
11.2.2. cancelled from the Customer’s order.
11.3. The Customer will be contacted by a customer service representative of the Suppliers to either select an alternative product or receive a refund.
12. CANCELLATION
Cancellation of any order by a Customer can only be accepted in accordance with the Distance Selling Consumer Protection Cancellation of Contracts Away from Business Regulations: 1987.
13. RETURN OF TICKETS
13.1. The Suppliers are committed to providing their Customers with the highest quality service.
13.2. However on rare occasions the wrong tickets may be sent to a Customer.
13.3. To the fullest extent permitted by law or statute ordered tickets cannot be returned by the Customer.
13.4. The Supplier gives no warranty of any kind (express or implied) that any information about tickets is accurate up to date or complete.
13.5. Only returns made in accordance with these Conditions will be accepted and are subject to the prior agreement of the Suppliers in each case.
13.6. Subject to the right of consumers to return goods for refund under Consumer Protection Regulations the Suppliers do not sell tickets on a trial basis.
13.7. Customers are strongly advised to check the suitability of any tickets before ordering.
13.8. Without prejudice to the restriction contained in clause 13.3. no return of tickets can be made by a Customer:
13.8.1. on or after the date to which those tickets apply.
13.8.2. if the tickets have been used in any way.
13.9. In the event that the Suppliers at their discretion agree to accept the return for credit of unwanted tickets the tickets must be returned with that Supplier’s prior agreement within five (5) Working Days of delivery.
13.10. Proof of postage is not proof of delivery and the Customer is therefore strongly advised to send the Customer’s package to the Suppliers by recorded delivery registered post or courier.
14. RETURN OF GOODS
14.1. The Suppliers are committed to providing their Customers with the highest quality service.
14.2. However on rare occasions the wrong products or damaged or defective products may be sent to a Customer.
14.3. In keeping with the Suppliers’ commitment to providing Customers with excellent service the Suppliers offer the returns facilities for products set out in this Clause 14.
14.4. The Supplier gives no warranty of any kind (express or implied) that any information about products is accurate up to date or complete.
14.5. No statements by the Suppliers relating to any products or services (including on the Web Site) constitutes any warranty that the products or services are fit for a particular purpose or of satisfactory quality.
14.6. Only returns made in accordance with these Conditions will be accepted.
14.7. Subject to the right of consumers to return goods for refund under Consumer Protection Regulations the Suppliers do not sell products on a trial basis.
14.8. Customers are strongly advised to check the suitability and specification of any products before ordering.
14.9. Any returned goods must be in perfect re-saleable condition and returned in their original packaging;
14.10. The Suppliers will accept the return of defective products for full refund or replacement only if the goods are returned within five (5) Working Days of delivery.
14.11. The Supplier’s customer service is able to advise the Customer which method of delivery to use to return the tickets or products depending on the nature of the product.
14.12. The Suppliers cannot accept liability for packages damaged during transit.
14.13. It is the Customer’s responsibility to wrap the product adequately to prevent damage;
14.14. Proof of postage is not proof of delivery and the Customer is therefore strongly advised to send the Customer’s package to the Suppliers by recorded delivery registered post or courier.
14.15. Any such package should be sufficiently insured by the Customer to cover the full purchase price of the items contained in it.
14.16. No refund shall be due in respect of any goods which have been opened used worn altered or damaged in any way by the Customer or its employees or agents.
14.17. No refund shall be due in respect of goods not used in accordance with the manufacturer’s instructions;
15. CUSTOMER SATISFACTION POLICY
15.1. The Suppliers operate a customer satisfaction policy.
15.2. If the Customer is not completely satisfied with the Customer’s experiences or the quality of any products or service supplied by the Supplier the Customer should contact the Supplier using the contact details on the Web Site
15.3.the Suppliers will duly investigate the Customer’s enquiry and make an initial reply to the Customer within fifteen (15) Working Days;
15.4. The Suppliers will also provide the Customer with an estimate as to the time required to resolve any problem reported by the Customer to the Supplier
15.5. The Suppliers will keep the Customer informed throughout this process.
16. COOKIES
16.1. When visiting or purchasing from this Web Site “cookies” may be left on the Customer’s PC.
16.2. A cookie enables the Customer to track orders and supply other mutually helpful information.
16.3. Cookies can be disabled from the Customer’s browser options but this may affect the Customer’s experiences on this Web Site.
17. LIABILITY
17.1. The Suppliers shall under no circumstances be liable for any consequential or indirect damage or loss (however caused) including (but not restricted to) loss of profits loss of goodwill damage to trading relationships, and financial loss arising in any from the Event or any transaction involving the Suppliers.
17.2. The Suppliers’ liability in respect of all other losses shall be limited to the invoiced value of the relevant order.
17.3. In accordance with the Health and Safety at Work etc Act 1974 and the Consumer Protection Act 1987 the Suppliers confirm that the goods it supplies do not present a hazard to health and safety when properly used for the purpose for which they are designed and when the Customer takes reasonable and normal precautions in their use.
17.4. Every effort is taken to ensure that product text and images accurately portray the products concerned.
17.5. Slight variations may occur.
17.6. If the Customer chooses to use the Web Site (including the purchase of products and services) the Suppliers will not be liable for any loss of profit income or business opportunity or any other direct or indirect loss which results from any failure or delay by the Supplier.
17.7. The Supplier shall not be liable in any way for any virus transmission from the Web Site to the Customer’s computer equipment.
17.8. Neither the Supplier nor any of the Suppliers’ employees shall be liable for any loss or damage suffered as a result of any use by the Customer or its invitees of the Site during the Event.
17.9. The Suppliers’ liability for death or personal injury caused by its negligence in the supply of any products or services or the conduct of the Event is excluded to the full extent permitted by law or statute only.
17.10. The Suppliers shall not be liable for any damage suffered by the Customer or its invitees or to their property of any kind in the course of the Event whether on the Site or otherwise.
17.11. The Suppliers shall not be liable for any damage suffered by any vehicle travelling to the Site for the Event arising from traffic delays en route.
17.12. Motor racing is dangerous and death or serious injury can be suffered by spectators.
17.13. Any financial liability of the Suppliers in any such case is limited to the insurance cover provided by the Motor Sports Association insurance for the event.
18. INTELLECTUAL PROPERTY
18.1. All Web Site design text graphics displays layout and all software compilations underlying source code software (including applets) and all other material on this Web Site are copyright of the Suppliers and their affiliates or their content and technology providers.
18.2. All rights are reserved.
18.3. The Suppliers or entities with which they have contracted own or are licensed to use all copyright database rights or similar rights and information within this Web Site;
18.4. Permission is granted to copy electronically and to print in hard copy only portions of this Web Site for personal use only following:
18.4.1. the placing of an order with the Suppliers or companies under their management or operation or
18.4.2. the Customer otherwise using this Web Site as a shopping resource.
18.5. All such replications must retain original copyright and proprietary notices.
18.6. Any other use of materials on this Web Site including reproduction for purposes other than those described above modification distribution or republication without the prior written permission of the Suppliers is strictly prohibited.
18.7. Other product and company names mentioned on this Web Site (including the name “Silverstone Classic” and the Speedmark logo) will be the trademarks or registered trademarks of their respective owners and no right of reproduction of the same is granted by their display.
19. CONTRACT RELATIONS
19.1. No contract will subsist between the Customer and the Suppliers for the sale by them to the Customer of any tickets or products or services unless and until:
19.1.1. (in the case of an order by telephone) the sales representative has confirmed acceptance of the order on the telephone (unless the Customer gives that representative details of the Customer’s email address whereupon clause 19.1.2. shall apply)
19.1.2. (in the case of an order via this Web Site) the Suppliers confirming by e-mail that they have accepted the Customer’s order.
19.2. That acceptance will be complete and for all purposes will have been effectively communicated to the Customer at the time the Supplier sends the e-mail to the Customer (whether or not the Customer receives that e-mail).
19.3. Any such contract will be deemed to have been concluded in England and shall be subject to English law only and the jurisdiction of the English courts in London only
19.4. The Suppliers reserve the right to use another court if they alone so decide.
