These Terms and Conditions do not affect your statutory rights.
1. DEFINITIONS AND TERMS AND CONDITIONS
- 1.1. "Suppliers" Classic Historic Racing Limited and Classic Sound Promotions Limited both of Field Place, Broadbridge Heath, West Sussex RH12 3PB.
- 1.2. "Web Site" This web site.
- 1.3. "Catalogue" means the electronic catalogue of products and services offered by the Suppliers or the other companies through which the Suppliers operate;
- 1.4. "Force Majeure" means any cause affecting the performance by the Suppliers of their respective obligations arising from acts, events, omissions, happenings or non happenings beyond their reasonable control including (but not limited to) governmental regulations, disease, fire, flood or any disaster or industrial dispute affecting a third party
- 1.5. "Working days" means Monday to Friday, excluding Bank or other Public holidays;
- 1.6. "Working Hours" means 0830-1700 UK Time;
- 1.7. "Site" means the Silverstone Circuits, Silverstone, Near Towcester, Northants, any building on the Silverstone site, or any Web-based store from which the Suppliers perform part or all of their businesses;
- 1.8. "we", "us", "our" "(the) Company" means the Suppliers;
- 1.9. "you", your" means the individual who is using the Site;
- 1.10. "(the) Customer" means the individual attempting to or actually performing a purchase;
- 1.11. "Consumer Protection Regulations" means The Consumer Protection (Distance Selling) Regulations 2000.
- 1.12. The Terms and Conditions of trading and Web Site use apply to all the Suppliers’ operations including those of any or all of their respective agents, partners, affiliates, joint ventures, organisers, managers and companies under the management or control of the Suppliers or their holding company however involved in the supply of products and or services on behalf of the Suppliers.
- 1.13. "Silverstone Classic " is the Trade Mark of The British Racing Drivers\' Club Limited whose registered office is: Eighth Floor, 6 New Street Square, London, EC4A 3AQ.
- 1.14. "Rocking and Racing" and the stylised guitar/race track logo are the Trade Marks of Classic Racing Events Limited (Company number: 06775260) whose registered office is at Field Place, Broadbridge Heath, West Sussex RH12 3PB
2. PRECEDENCE
The order of precedence (in the hierarchy of importance of the legal provisions applying to any transaction relating to the Event) is:
- 2.1. Any Additional Terms and Conditions or Limitation of Use applied to individual products, tickets, services or promotions issued or provided by the Suppliers or any other person or entity on their behalf;
- 2.2. In relation to tickets specifically, Section 21 below;
- 2.3. These standard Terms and Conditions in their entirety.
3. SERVICE OFFERING
- 3.1. The Company reserves the right to refuse to trade with individuals whose credentials cannot be verified, including those living in countries where credit/debit card fraud is known to be active.
- 3.2. The Company will use discretion in these matters and the resultant decision will be final.
- 3.3. Any decision by the Company not to accept an order does not imply that the Company considers that the Customer who made that order is engaged in any fraudulent or other delinquent conduct.
- 3.4. Methods of ordering include:
- 3.4.1. Via the Internet at the relevant Web Site address;
- 3.4.2. By Telephone using the numbers advertised;
- 3.4.3. By post and cheque;
- 3.4.4. By cash or credit card on the day.
- 3.5. All tickets, products and services are subject to availability;
- 3.6. The Suppliers make reasonable efforts to supply goods and services as advertised but reserve the right to vary the performers at any concert, the content of any grids and drivers in any race programme, the holding of any race or any other attraction, the content and design of any goods and the scope of any services at any time at their sole discretion;
- 3.7. In the event that any of the Suppliers cannot supply the goods or services ordered by the Customer, the Suppliers reserve the right to offer goods of equal or superior quality or value at no extra cost.
- 3.8. If the Customer does not wish to accept the alternative goods offered the Customer may cancel the order and require any money paid to the Suppliers in respect of that order to be refunded.
4. ORDER FULFILMENT
- 4.1. All contracts of sale made by any of the Suppliers shall be deemed to incorporate these terms and conditions, which shall (save as provided in Clause 2.1) prevail over any other terms;
- 4.2. Goods and services, together with VAT, are invoiced at the price prevailing at time of order.
- 4.3. The Suppliers reserve the right to modify the prices from time to time;
- 4.4. Paid orders will be acknowledged with a Payment Confirmation e-mail;
- 4.5. In the event of any tickets being sold out or any products being out of stock the Suppliers may contact You to advise of any alternative tickets which are still available or, in the case of any products, an estimated delivery date and enquire if You wish to receive an alternative product or not to proceed with your intended purchase of either tickets or products. For this reason, please ensure You provide contact details during the registration process.
5. PAYMENT PROCESSING
- 5.1. Banking Institutions
Payment processing is performed via SSL secure connections between Our servers and the Banking Institutions; - 5.2. Credit/Debit Card Payment;
- 5.2.1. The Suppliers accept the following Credit and Debit Cards, MasterCard,Visa, Switch, Solo and Delta only;
- 5.2.2. The Suppliers reserve the right to refuse to trade with any person where fraudulent use of credit/debit cards is suspected as determined by the Suppliers;
- 5.2.3. The Suppliers reserve the right to refuse to transact with any Country or Countries where fraudulent use of credit/debit cards is considered by the Suppliers as excessive risk;
- 5.2.4. Please ensure all card details are entered correctly on the order form as incorrect data will result in the credit/debit card being rejected for payment and can cause delays to the order fulfilment process;
- 5.2.5. Payment is charged to the credit/debit card on confirmation of successful payment and items ordered are in stock;
- 5.2.6. For Delivery addresses that are different to the Card Holder’s address please ensure that the Invoice/Billing address is the same address as that of the Card Holder;
- 5.2.7. The Suppliers reserve the right to request additional identification in respect of credit/debit card or address verification if deemed appropriate.
6. PACKING, POSTAGE & DELIVERY
- 6.1. Please see Delivery Information and prices applicable to the individual Web Site;
- 6.2. Postage of tickets incurs a charge of £2 postage and packaging.
- 6.3. Any time or date stated for delivery is an estimate only.
- 6.4. The Suppliers make every effort to despatch tickets or goods on time, but do not accept liability for failure to deliver within the stated time;
- 6.5. Delivery is provided through third party courier and postal companies and the Suppliers are not liable for delays or loss incurred;
- 6.6. Some orders will require a signature on delivery so if possible please provide a delivery address where the order can be signed for in normal Working Hours;
- 6.7. The Suppliers do not accept liability for shortages or damage to deliveries unless the Customer notifies Us of the shortage or damage in writing within 7 days of receipt of the delivery;
- 6.8. The Customer has to accept the tickets or goods when they are ready for delivery;
- 6.9. Delivery is deemed to take place when the goods are delivered to the Customer\'s nominated address, whereupon the risks of loss, breakage and all damage shall pass to the Customer;
- 6.10. Title in the goods does not pass to the Customer until payment is received in full by the Suppliers;
- 6.11. If the Customer cannot accept delivery, the Suppliers may at their option:
- 6.11.1. store and insure the tickets or goods at the Customer\'s expense and risk or;
- 6.11.2. sell the tickets or goods at the best price reasonably obtainable and (after deducting reasonable storage insurance and selling costs) pay to the Customer any excess over the sale price or charge the Customer for any shortfall.
7. OUT OF STOCK AND NON-AVAILABILITY
- 7.1. Products out of stock but on order are normally delivered within 28 working days but can occasionally take longer and will be exempt from delivery clause 6;
- 7.2. Items that are no longer available will be:
- 7.2.1. Removed from the Web Site;
- 7.2.2. Cancelled from your order;
- 7.3. You will be contacted by a Customer Service representative of the Suppliers to either select an alternative product or receive a refund.
8. CANCELLATION
Cancellation of any order by a Customer can only be accepted in accordance with the Distance Selling Consumer Protection Cancellation of Contracts Away from Business Regulations: 1987.
9. WARRANTIES AND RETURNS
- 9.1. The Suppliers are committed to providing their Customers with the highest quality products and service. However, on rare occasions, the wrong tickets may be sent to a Customer, products may be found to be faulty or defective, and in keeping with our commitment to providing Customers with excellent service, we offer the returns facilities set out below;
- 9.2. All goods supplied by the Suppliers are warranted to be generally free from defects in workmanship and materials and fit for the purpose for which such goods would normally be used.
- 9.3. Subject to this, however, goods are not tested or sold as being fit for any particular application or for use under specific conditions, unless expressly agreed in writing;
- 9.4. Subject to the right of consumers to return goods for refund under Consumer Protection Regulations, the Suppliers do not sell tickets or products on a trial basis.
- 9.5. Customers are strongly advised to check suitability and specifications of any tickets or products before ordering;
- 9.6. In the event that any of the Suppliers, at its discretion, agrees to accept the return for credit of unwanted tickets or products, the goods must be returned with that Supplier’s prior agreement within seven (7) days of delivery.
- 9.7. The goods must be in perfect re-saleable condition and returned in original packaging;
- 9.8. The Suppliers will accept the return of defective products for full refund or replacement, if the tickets or goods are returned within 7 days of delivery.
- 9.9. The Suppliers’ Customer Service is able to advise you which method of delivery to use to return the tickets or products depending on the nature of the product;
- 9.10. Only returns made in accordance with these terms and conditions will be accepted;
- 9.11. The Suppliers cannot accept liability for packages damaged during transit. It is the Customer\'s responsibility to wrap the product adequately to prevent damage;
- 9.12. Proof of postage is not proof of delivery and you are therefore strongly advised to send your package by recorded delivery, registered post or courier, and to maintain sufficient insurance to cover the value of the goods;
- 9.13. This warranty shall not apply if the tickets have been used or the goods have been opened, used, worn, altered or damaged in any way by the Customer or its employees or agents, or to goods not used in accordance with the manufacturer\'s instructions;
- 9.14. Some products (particularly tickets) may be declared as non-returnable. These will be clearly identified at the time of purchase;
- 9.15. We give no warranty of any kind, express or implied: that any information about tickets, products or services is accurate, up to date or complete; or that any statements by us relating to any products or services, included on the Web Site, constitutes any warranty that the tickets, products or services are fit for a particular purpose or of satisfactory quality.
10. CUSTOMER SATISFACTION POLICY
- 10.1. The Suppliers operate a Customer Satisfaction Policy. If you are not completely satisfied with your experiences, products or service at any of the Suppliers outlets:
- 10.1.1. Please contact the Suppliers’ offices using the Contact Information below and
- 10.1.2. the Suppliers will duly investigate your enquiry and make an initial reply to you within fifteen working days;
- 10.2. The Suppliers will also provide you with an estimate as to the time required to comprehensively resolve your issue, keeping you informed throughout the process;

11. SECURITY & SSL
- 11.1. Cookies. When visiting or purchasing from this Web Sites, "cookies" may be left on Your PC. A cookie enables you to be able to track your orders and supply other mutually helpful information. You can disable cookies from your Browser Options but this may affect your experiences on this Web Site;
- 11.2. The use of Secure Socket Layer (SSL) is a protocol used on the Internet to encrypt data to ensure secure transmission. This functionality is denoted by a padlock symbol at the bottom of your browser.

13. LIABILITY
- 13.1. The Suppliers shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, including (but not restricted to) loss of profits, loss of goodwill, damage to trading relationships, and financial loss.
- 13.2. The Suppliers’ liability in respect of all other losses shall be limited to the invoiced value of the relevant order;
- 13.3. Nothing in this agreement shall limit the Suppliers’ liability for death or personal injury caused by its negligence;
- 13.4. In accordance with the Health and Safety at Work etc Act 1974 and the Consumer Protection Act 1987, the Suppliers confirm that the goods it supplies as a distributor do not present a hazard to health and safety when properly used for the purpose for which they are designed and when the Customer takes reasonable and normal precautions in their use;
- 13.5. Every effort is taken to ensure that product text and images accurately portray the products concerned. Slight variations may occur;
- 13.6. If You chose to use the Web Site (including the purchase of products and services) we will not be liable for any loss of profit, income or business opportunity or any other direct or indirect loss which results from any failure or delay by us;
- 13.7. In no circumstances shall We or any of our employees be liable for any loss or damaged suffered as a result of any use of the Site though we do not exclude any liability from death or personal liability caused by our negligence.
- 13.8. Motor racing is dangerous and death or serious injury can be suffered by spectators. The liability of the Suppliers in any such case is limited to the cover provided by the MSA insurance for the event.
14. INTELLECTUAL PROPERTY
- 14.1. All Web Site design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on this Web Site are copyright of Classic Racing Events Limited, and its affiliates, or their content and technology providers. All rights are reserved.
- 14.2. Classic Racing Events Limited or entities with which it has contracted own or are licensed to use all copyright, database rights or similar rights and information within this Web Site;
- 14.3. Permission is granted to copy electronically and to print in hard copy portions of this Web Site for personal use where the sole purpose of placing an order with the Suppliers or companies under their management or operation or using this Web Site as a shopping resource. All such replications must retain original copyright and proprietary notices.
- 14.4. Any other use of materials on this Web Site including reproduction for purposes other than those noted above, modification, distribution, or republication without the prior written permission of Classic Racing Events Limited is strictly prohibited;
- 14.5. Silverstone Classic, and/or other Silverstone Classic services referenced on this Web Site are trademarks or registered trademarks of The British Racing Drivers\' Club Limited in the UK and/or other countries.
- 14.6. Other product and company names mentioned on this Web Site may be the trademarks or registered trademarks of their respective owners.
15.
- 15.1. No contract will subsist between you and any of the Suppliers for the sale by any of them to you of any tickets or products or services unless and until any of the Suppliers accepts your order by e-mail confirming that it has accepted your order.
- 15.2. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time the Supplier sends the e-mail to you (whether or not you receive that e-mail).
- 15.3. For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom.
- 15.4. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England and Wales, and you irrevocably submit to the exclusive jurisdiction of the English Courts in London.
- 15.5. The Suppliers reserve the right to use another court if they so elect.
16. PRIVACY POLICY

17. FORCE MAJEURE
Where, in spite of its reasonable efforts, any of the Suppliers is unable to perform an obligation due to force majeure, it shall not be deemed to be in breach of its contract with the Customer.
